§ 12.303. Petition for improvement.

  • Sec. 1.182. When the owners of a majority of the lands liable to be assessed in any special assessment district then, or thereafter to be constituted, shall petition the Council for any of the public improvements, the Council shall direct the plans and specifications and estimates of cost be made by the City Engineer and submitted to the Council on or before a date to be designated not exceeding ninety (90) days. Upon receiving the plans and specifications and the estimated cost of the proposed improvements, the Council shall determine whether such public improvement shall be made and whether the whole or any part of the cost and expenses thereof shall be specially assessed against the lands benefitting or to benefit therefrom, and what part, if any, shall be appropriated from the General Funds of the City, and determine the districts or lands and premises upon which special assessments shall be levied.
